1. Factual and visual scope

The report is made exclusively on the basis of the visual interpretation of the photographs and information provided by the client. Amberg does not carry out any independent on-site verification. Amberg's liability is strictly excluded for any damage resulting from hidden defects, elements that are not apparent in the photos transmitted, or incorrect and incomplete information provided by the client.

2. Nature of the service and duty to advise

The client acknowledges that this report is a strictly preliminary decision-making tool.

3. Non-binding

This document does not constitute a design study or a work protocol. Any intervention on the structure requires a complete physical expertise before hand. The client undertakes to have a thorough physical inspection carried out by a qualified expert before any operational decision or execution of any work.

4. Compensation cap

By express agreement between the parties and taking into account the reduced fixed price of the service compared to a physical expertise, Amberg's overall contractual liability for each report is limited to the amount actually paid by the client for the report before tax. This cap does not apply in cases of fraud or gross negligence.

5. Intellectual Property

Amberg retains exclusive ownership of all intellectual property rights in the studies, analyses and reports produced. The client is entitled to use the report only for its internal information and may not pass it on to third parties as an official specification or workpiece without written consent.

6. Mandatory Prior Mediation

In the event of a dispute relating to the validity, interpretation, or performance of this agreement, the parties undertake to submit their dispute to a 30‑day mediation procedure administered by the Swiss Chamber of Commercial Mediation (SCCM) or another mutually agreed Swiss mediation body. Initiating mediation is a mandatory prerequisite before any legal action.

7. Governing Law and Jurisdiction

This agreement is governed by Swiss substantive law. Any dispute arising between the parties shall fall under the exclusive jurisdiction of the courts of Zurich, Switzerland, unless mandatory provisions of Swiss law require otherwise.

Communications are deemed received on the business day on which they reach Amberg's email server. Amberg may update its official contact address by written notice to the client.
